These terms govern use of the EIGHTHSPACE website and provide the baseline for our services. Your signed proposal or service agreement contains the project-specific commitments.

1. Agreement to these terms

By using this website, submitting an enquiry, creating or using a client workspace, or purchasing services from EIGHTHSPACE, you agree to these Terms of Service. If you act for a business, you confirm that you have authority to accept terms on its behalf.

A signed proposal, statement of work or service agreement takes priority if it conflicts with these general terms. The Privacy Policy, Cookie Policy and Cancellation & Refund Policy form part of these terms.

2. Services and project scope

EIGHTHSPACE provides website strategy, design, development, launch, support and related creative or technical services. The exact pages, features, integrations, delivery estimates, revision rounds, responsibilities and fees will be stated in your proposal or agreement.

Website descriptions and pricing are invitations to enquire, not a binding offer. A project begins only after scope and fees are accepted, any required agreement is signed, and the stated initial payment is received.

3. Timelines and client responsibilities

Published delivery periods are estimates that begin after we receive the required payment, content, assets, access and approvals. You agree to provide accurate information, lawful materials, consolidated feedback and approvals within the agreed time.

Delayed content, feedback, payment, access or third-party responses may move the delivery date. If a project becomes inactive, we may pause it and agree a revised schedule before work resumes.

4. Fees, taxes and third-party costs

Fees and payment milestones are shown in the accepted proposal. Applicable taxes, transaction fees and third-party products may be charged separately where stated. Overdue amounts may pause work, launch, file transfer or ongoing support.

Domains, hosting, email, fonts, stock assets, plugins, booking tools, payment services and similar products are governed by their own provider terms and renewal prices. We will identify material recurring charges we know about, but providers may change their products or prices independently.

5. Revisions and approvals

The included revision rounds are stated in the project scope. A revision adjusts approved scope; a new page, feature, direction or substantial rewrite may be quoted as additional work. Approval of a stage authorises us to proceed and later changes to that stage may affect cost and timing.

6. Client materials and lawful use

You retain ownership of material you supply and grant EIGHTHSPACE a limited licence to use it for the project. You confirm that you have the rights and permissions needed for all supplied text, images, trademarks, data and other material, and that your website and instructions will not violate law or third-party rights.

We may refuse or remove unlawful, deceptive, infringing, harmful or abusive material. You remain responsible for your business claims, products, services, regulatory disclosures and the accuracy of final content.

7. Ownership and portfolio use

After all project invoices are paid, you receive the agreed rights in the final custom deliverables. EIGHTHSPACE retains ownership of pre-existing methods, know-how, reusable code, development tools and internal systems. Third-party assets remain subject to their licences.

Unless a written confidentiality or non-display agreement says otherwise, we may identify the project and show the finished work in our portfolio, proposals and studio communications after it becomes public.

8. Launch, support and maintenance

We will perform the agreed pre-launch checks, but websites depend on browsers, devices, hosting and third-party services that change over time. Included post-launch support covers the period and issues stated in the proposal. New content, new features, third-party changes and ongoing maintenance require a care plan or separate quote.

9. No guaranteed business outcome

We aim to deliver professional, accessible and search-ready work, but do not guarantee search rankings, traffic, enquiries, revenue, conversion rates or uninterrupted availability. Outcomes also depend on your offer, market, content, promotion and third-party platforms.

10. Accounts and acceptable use

Client and agency workspaces are private. Do not attempt to access another project, share protected links or credentials without permission, introduce malicious code, overload the service, scrape restricted data or interfere with security. You are responsible for activity performed through your account and should report suspected misuse promptly.

11. Cancellation and termination

Either party may end a project as permitted by the accepted proposal and our Cancellation & Refund Policy. We may suspend or terminate access for non-payment, unlawful use, serious breach, security risk or conduct that makes safe delivery impracticable. Accrued payment, confidentiality, ownership, liability and dispute provisions survive termination where relevant.

12. Liability

To the fullest extent permitted by law, neither party is liable for indirect, incidental, special or consequential loss, lost profits or lost data arising from the services. EIGHTHSPACE’s total liability relating to a claim will not exceed the fees paid for the affected service during the twelve months before the event giving rise to the claim. Nothing excludes liability that cannot lawfully be excluded or limits mandatory consumer rights.

13. Governing law and disputes

These terms are governed by the laws of India. We will first try to resolve concerns in good faith through written communication. If that does not resolve the issue, courts with competent jurisdiction where EIGHTHSPACE is established will have jurisdiction, subject to any mandatory consumer forum or other rights available under applicable law.

14. Contact and changes

Questions may be sent to info@eighthspace.in. We may update these terms to reflect service or legal changes. The latest version and effective date will be published here. Changes do not rewrite an already signed project agreement unless both parties agree or the law requires it.
